URGENT PETITION TO URGE AN END TO PACIFIC RIM'S LAWSUIT AGAINST EL SALVADOR

Please consider adding your organizational sign-on to the letter below regarding a particularly egregious corporate lawsuit against the government of El Salvador brought under the DR-CAFTA free trade agreement.

We are organizing this open letter on short notice because we expect an imminent ruling from a World Bank tribunal regarding this case. A group of labor union, environmental, and other civil society leaders will deliver the letter at a rally outside the World Bank on Thursday, Dec. 15. It will also be delivered to the media and to the lawyers and officers of the global mining corporation that filed the lawsuit, Pacific Rim. Please help us send a message that these anti-democratic corporate powers are unacceptable and international civil society is fighting back. ?

The signers of this petition represent more than XXX civil society organizations. We are writing out of solidarity with the communities of El Salvador that have been working through the democratic process to prevent a proposed cyanide-leach gold mining project, over well-founded fears that it threatens to poison the local community's environment as well as the country's most important river and source of water.

Rather than complying with the environmental permitting process of El Salvador, Pacific Rim launched an attack under the Dominican Republic-Central American Free Trade Agreement (CAFTA). They are demanding compensation from the government of El Salvador that could rise to hundreds of millions of dollars. In an abuse of process designed to attract jurisdiction under DR-CAFTA, Pacific Rim moved its subsidiary from the Cayman Islands to Nevada in the United States. The case will be decided by a tribunal at the International Centre for Settlement of Investment Disputes (ICSID), associated with the World Bank.

Pacific Rim is using ICSID and the investor-state rules in a free trade agreement to subvert a democratic nationwide debate over mining and sustainability in El Salvador. These matters should not be decided by an ICSID arbitration tribunal. In the course of Pacific Rim's intervention in the political affairs of El Salvador, four anti-mining activists have been murdered in the project area.

We stand with these communities and the government of El Salvador in their demand that their domestic governance processes and national sovereignty be respected, and thus that this case be dismissed. We stand on the side of democracy.

Esta petición está firmada por más de XXX organizaciones de la sociedad civil. Escribimos en solidaridad con las comunidades en El Salvador que han trabajado por medio de procesos democráticos para frenar un proyecto de minería de oro que incluye el uso de cianuro que amenaza con envenenar el medio ambiente de las comunidades locales así como el río Lempa, que constituye la fuente de agua más importante del país.

En lugar de cumplir con el proceso de aprobación en materia ambiental de El Salvador, la compañía canadiense Pacific Rim entabló una demanda bajo el Tratado de Libre Comercio entre Centroamérica, Estados Unidos y la República Dominicana (el DR-CAFTA por sus siglas en inglés). Pacific Rim está demandando compensación del gobierno de El Salvador que podría llegar a cientos de millones de dólares. Abusando del proceso para atraer jurisdicción bajo el DR-CAFTA, Pacific Rim mudó su subsidiaria de las Islas Caimán al estado de Nevada en los Estados Unidos. El caso será decidido por un tribunal del Centro Internacional de Arreglos de Diferencias Relativas a Inversiones (CIADI) del Banco Mundial.

Pacific Rim está usando al CIADI y las reglas inversionista - Estado de un tratado de libre comercio para socavar un debate nacional y democrático en torno a la sustentabilidad de la minería en El Salvador. Estos asuntos no deberían de ser decididos por un tribunal de arbitraje como el CIADI. En el transcurso de la intervención de Pacific Rim en los asuntos políticos de El Salvador, cuatro activistas ante la minería han sido asesinados.

Estamos en solidaridad con estas comunidades y el gobierno de El Salvador en su demanda de que su proceso doméstico de gobernabilidad y su soberanía nacional sean respetados, y por lo tanto que este caso sea desechado. Estamos del lado de la democracia.
